Georgia Supreme Court Considers Cap on Pain and Suffering in Medical Malpractice Cases

In 2005, the Georgia Legislature imposed a cap on noneconomic damages in medical malpractice cases  regardless of the merits of the case or the injury to the plaintiff.   The cap is $350,000.   Several years ago, a jury rendered a verdict that exceeded the cap and the Georgia Supreme Court is now considering whether the cap is constitutional.  Let’s hope they decide in favor of letting juries decide damages and not impose some arbitrary cap to protect doctors and hospitals that injure innocent victims.
